Nexaro - Manufacturer's Warranty
The following warranty terms and conditions for the Nexaro Manufacturer’s Warranty define the requirements and scope of Nexaro’s warranty services. The purchaser’s statutory rights against the seller in the event of defects remain unaffected. The purchaser may assert such rights free of charge and independently of this Manufacturer’s Warranty. In addition, Nexaro grants end customers a Manufacturer’s Warranty for Nexaro devices in accordance with the terms set forth below:
1 General Provisions
- The warrantor under these warranty terms and conditions is Nexaro GmbH, Blombacher Bach 3, 42287 Wuppertal, Germany (hereinafter also referred to as “Nexaro”).
- Only purchasers of Nexaro cleaning robots (hereinafter referred to as “Devices”) are eligible as warranty beneficiaries, provided that the Device was purchased from Nexaro or from an authorized Nexaro dealer within the European Union for the purchaser’s own use and not for resale.
- This Manufacturer’s Warranty does not affect or limit the purchaser’s statutory warranty rights.
2 Manufacturer’s Warranty; Warranty Period
- Upon purchase of a Nexaro Device, Nexaro grants the warranty beneficiary a Manufacturer’s Warranty in accordance with these warranty terms and conditions, provided that the Device is free from material, software, or manufacturing defects at the time of delivery to the warranty beneficiary.
- The Manufacturer’s Warranty is valid for a period of twelve (12) months from the date of invoice. The warranty period shall not be extended due to the provision of warranty services. Warranty services neither suspend nor restart the warranty period.
- This Manufacturer’s Warranty is not transferable to other devices. In the event the Device is resold to a third party, the subsequent owner of the Device may claim the original warranty services.
3 Requirements and Exclusions
- Claims under this Manufacturer’s Warranty shall not exist if:
- the defect is due to normal wear and tear or use-related deterioration;
- the Device shows signs of damage resulting from accident, misuse, improper care or maintenance, modification of hardware or software, or repairs or other interventions performed by third parties not authorized by Nexaro;
- unauthorized spare parts have been installed in the Device or unauthorized accessories have been used;
- the serial number of the Device has been removed or rendered illegible;
- the Device has been taken outside the European Union without Nexaro’s prior consent;
- the Device has been imported into the European Union without Nexaro’s prior consent.
4 Assertion of Warranty Claims
- Warranty claims must be asserted against Nexaro within the applicable warranty period.
- The warranty beneficiary must provide proof of the warranty period by submitting the invoice, including the invoice date and the Device’s serial number.

5 Warranty Services
- In the event of a valid warranty claim, Nexaro will remedy the defect by repairing or replacing the affected parts or by supplying a replacement device. The choice of warranty remedy shall be at Nexaro’s sole discretion. A replacement may also be fulfilled by providing a functionally equivalent refurbished device. Replaced parts or devices shall become the property of Nexaro.
- In the event of a warranty claim, the warranty beneficiary must send the Device to Nexaro. Within the territorial scope of this warranty, Nexaro shall bear the costs of shipment to and from Nexaro, provided that the warranty beneficiary uses the carrier designated by Nexaro and the return label provided by Nexaro. If the warranty beneficiary incurs costs by deviating from these requirements, Nexaro shall not be responsible for such costs.
- No further or other claims beyond those expressly stated above shall exist under this Manufacturer’s Warranty.
6 Burden of Proof
The warranty beneficiary bears the burden of presenting and proving the existence of a valid warranty claim. It shall not be presumed that defects arising during the warranty period already existed at the time risk passed or during the entire prior warranty period.
7 Governing Law; Jurisdiction
- These warranty terms and conditions shall be governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
- If the warranty beneficiary is a merchant, a legal entity under public law, or a special fund under public law, the place of performance and exclusive jurisdiction for all disputes arising out of the warranty relationship shall be Nexaro’s registered office. This shall also apply if the warranty beneficiary is a business entity without a general place of jurisdiction in Germany. However, Nexaro shall also be entitled to bring an action against the warranty beneficiary at its registered place of business.
